EB5 for startup receiving investment from an Indian investor?

Folks,

I am an Indian citizen with a valid B1 visa. I keep traveling to US on business. I studied in the US from 1998 to 2000 (F1) and then worked from 2000 to 2003 (H1B). I did not apply for PR during my stay and moved back to India in 2003.

I had created a Delaware C Corp in 2019 for my SaaS startup. I now have an Indian investor investing ~$800K in my US company. The funds will come in within March.

- Does this investment make me eligible to apply for PR under EB5 category?

- Does the investment need to come from my account or is it OK if my investor is directly putting in the funds in my US company's bank account?

- Is $1M limit mandatory or $800K eligible? I am flexible on the location of the company.
