KSRajaRam
Hello All, Thanks in advance for the assistance. I'm a F1 student currently on OPT. I recently got charged with Class B Misdemeanor for theft in Texas (the amount of theft was $105). My first court date is on DEC 3rd 21. I'm due for STEM Extension in July 2022. What are the things I need to know so I can get into the right agreement for the diversion program/ please suggest ways that can avoid future immigration issues. I know that the a Class B misdemeanor in TX is punishable by up to 180 days in jail, a fine of as much as $2,000, or both. I spoke to my criminal attorney and he mentioned that I wouldn't receive Jail time as this is my first time. 1. Will my Visa be revoked? Are there chances of deportations'? 2. Will my STEM extension be denied if the case is still pending? 3. What should my eligibility criteria be if I'm applying for extension (Q:27 on i-765, normally it is C3C) 4. Do I have to send docs related to the case( police report or disposition) with the extension application Quote Link to comment
pontevecchio
You should discuss the matter with an Immigration Lawyer. Quote Link to comment
02112018
I am not sure what triggered you steal $105 worth of stuff, if that is true. Even though you are doing a white collar job. If you did not do this on purpose and if you can prove that to court, you will be just fine. If not, face the consequences. Immigration Lawyer is the GOD for you now. Quote Link to comment
