DUI on J1, DS2019 renewal soon, wife on J2 EAD and applying for H1B

Hi, I just got arrested for DUI? I have applied for reappointment with my university so that I can get an extended DS2019. My wife is on J2 EAD and doing a good job. Her employers might be applying for her H1B. I have also requested for advisory opinion because the 2 years' home country is wrong on my DS. I don’t have a court date yet and I was not fingerprinted during the arrest. Can my advisory opinion, DS2019 renewal, my wife’s H1B be affected by this? Will her current EAD go invalid? I don’t know what will happen to me, but I want her to get her own H1B. We have 11 yr kid. Please help!! I am not an alcoholic and this is my first time in this situation. Please help!!

The advisory opinion has no connection to your DUI. Under your circumstances, one should ALWAYS keep an Immigration Lawyer in the loop.

I am exactly in your situation. 98% similarity with your case, J1 (waiver applied, home country document thing is almost done except the home state department, will apply here soon), talked with employer for H1b, and Tenure Track Job on the line and I am really clueless.

Except the court date which is different for me, I somehow felt regretful and disappointed for my action, and wanted to take the responsibility and own my mistake, so that nothing like this ever happens and I can atleast say I did a mistake which I own and learned a big lesson, you have to be mindful about your decisions in life. I represented myself and pleaded no-contest and asked for probation. Judge put a next date for probation sentencing, it due end of this year. J1 extension form submitted two days back.

Update if it helps you:

1. I got my J1 extension till the December next year (2022).

2. I have sent my J1-waiver package to the waiver review office.
