sai76201 Posted September 7, 2021 Report Posted September 7, 2021 I currently work for employer A with H1b/I94 valid until 09/2022 I got an offer from employer b who initiated h1b transfer a week back and i received RFE(not sure what the RFE is yet and also i haven’t joined employer B) I got another offer from employer C today. Q1. Can employer C file for transfer when employer B’s petition is in RFE? Q2. If Yes, what would happen in case employer B’s rfe gets denied. Quote
Zodiac System Posted September 8, 2021 Report Posted September 8, 2021 Employer C can file for transfer when employer B's petition is in RFE. Better to ask employer B to withdraw the petition as denials do not look good on your immigration records. Good Luck. Quote
