Kiranmca04 Posted July 7, 2021 Report Posted July 7, 2021 Hi, When i was with my previous employer X who applied my I-140 which was approved. They also promised me that they don't revoke that I-140 as it was paid by me. Later i moved to a new employer Y and i am currently using previous I-140 for H1 extensions. It is been close to 4 years my current employer not started green card process. My priority date is 2016 December which is on EB2. 1. What happens all of a sudden my priority date become current ? Can I go back to my previous employer and continue with GC process? Is there any challenges with that other than job? 2. As i my current employer is not planning to apply GC, can I find another job and apply GC with new company? any issues here? 3. If is stick here in the current company Y, how long i can go for H1b extensions assuming USCIS dates are moving slowly. Thanks in advance. Quote
gopalakrishnach Posted July 8, 2021 Report Posted July 8, 2021 (edited) If your old employer do not want to start GC better find new employer ..get H1B approved,,, start GC process with them and you can use old I140 priority date.. Edited July 8, 2021 by gopalakrishnach Quote
Zodiac System Posted July 9, 2021 Report Posted July 9, 2021 Ans.1 You can go back to your old employer and continue with GC process. Ans. 2 Yes. You can retain the priority date. Ans. 3 You can continue with current company Y and keep extending (hoping that immigration rules will continue to remain what they are at present). Quote
