Patta Posted September 15, 2011 Report Share Posted September 15, 2011 Hi All, My question is if I get the H1B extension ( say for another 3 years) based on the approved I-140 with employer A and then change to employer B , will there be any legal problems. What will happen if employer A cancels my I-140 . Will my extension on the approved I-140 still holds good? . Please advise on how to act in these situations and what precautions do I need to take . Attorney_9 Posted September 16, 2011 Report Share Posted September 16, 2011 If Company A withdraws your approved I-140 that should not affect the H-1B extension that you have already received with Company B. However, Company B will need to file a new LC case in order to give you the ability to continue to extend your H1B status. Link to comment
