newuser111 Posted May 12, 2021 Report Share Posted May 12, 2021 (edited) Hi Looking for some information from the community here So I do work for company A with approved I-140 ways back from 2016 and I am currently in my 8th year of H1B visa and will need an extension again before it ends next year sept 2022. I am looking to change jobs and say if I get offer from company B later this year and they decide to start PERM/140 process next year with them and say PERM is still pending before my visa end date 1. So will I be able to file H1B extension at company B in year 2022 since perm is pending less than 365 days? 2. Can we file the H1B extension based on previous companies approved I-140 even when they revoked I-140 since I left the job or is that something not possible. Please advice. Zodiac System Posted May 13, 2021 Report Share Posted May 13, 2021 (edited) You should be able to file your your transfer/extension with new company using your existing I140 approval.
