Khush Posted April 25, 2021 Report Share Posted April 25, 2021 Hi Guys, Hope you all are doing well! Please help me figure out the next possible step to get back to the US. My H1B 7th year extension got denied in the Mar 2021 last year and I had to get back to India. I got intra company transfer and working from Indian since last year. However, looking at the current situation triggered by pandemic, it does not look like my company is going to file the extension anytime soon. Is it advisable to file the extension via some consulting company or do you suggest any better solution to deal with the situation? PS: I have an approved I-140 which makes my H1B cap exempted. Attorney_15 Posted April 29, 2021 Report Share Posted April 29, 2021 Someone who has an approved I-140 Petition does qualify for the H1B extensions and an employer can use this feature to file an H1B Petition for the beneficiary who is outside the United States. While currently the pandemic spike of cases in India makes getting a visa more challenging, this would therefore probably be the ideal time to spend of getting a petition filed and approved.
