MRY
Hello, My client location has changed within the same MSA from March 1, 2021. My current H1B expires on Aug 31, 2021. My employer says that they will file H1B extension choosing the category "Change in previously approved employment". In such case, the start and end date in LCA and petition will be April 1, 2021 to March 30, 2024 because employer planning to file LCA and initiate extension process on April 1,2021. Please note that there is no change in client, job title or job duties. I am concerned about losing 5 months of H1B approval. Would it be right to file LCA/Petition as "Continuation of previously approved employment" requesting start date from Sept 1, 2021 to Aug 31, 2024? Any other suggestions so that i do not lose the approval of about 5 months period. Thanks in advance. Quote Link to comment
Zodiac System
Your employer must have consulted his company attorney for this filing (all employers do). You should be good. Quote Link to comment
