Our respective organizations filed for our H1B extensions in 2019, but due to covid and closure of consulates, we couldn't travel outside USA to get new visa stamps. However our I797 notices have the updated I94 expiration dates. My question is - under Automatic revalidation provision, can we travel to Canada for a few days and re enter USA by road with the valid I94 and expired visa ? The I94 expiration date on I797 approval notice doesn't match the I94 expiration date on CBP website. What steps could we take to ensure smooth return to USA ? Quote Link to comment
pontevecchio Posted March 5, 2021 Report Share Posted March 5, 2021 Assuming covid restrictions on Canada USA travel are lifted before you travel, you need to show the valid I94 to use AVR and return. You need to clearly state that you are using AVR. Quote Link to comment
