vQuery6 Posted February 15, 2021 Report Share Posted February 15, 2021 I would like to know that , when my employment is ending on say Jan1[is my termination date/last pay date], and my next company is filing for the transfer of visa on Feb 20, which is within the grace period.I will be filing the pay slips till Jan1, and my current I797 is valid till current year end. But my question is , 1) while they file for the h1b transfer, the pervious company will be revoke my h1b on jan1, so is there any documents that the hiring company needs to file EXTRA for this h1b transfer process. 3) once the current employer revoke the H1B on Jan 1, Does that mean that I will be out of status? JoeF Posted February 16, 2021 Report Share Posted February 16, 2021 The previous employer by law had to inform USCIS that you no longer work there, which results in revocation of the H1. That has absolutely zero effect on you. You have a 60 day grace period from the day of layoff. That's all you need to care about Quote Link to comment
