my4visa Posted July 26, 2011 Report Share Posted July 26, 2011 Hi, I got my F1 Visa in 2006. I converted F1 to H1B on 2008 and since then I dint come back to India until 2011. I came to India and got married. I went to Kolkata consulate for H1B stamping. They rejected and they cancelled my Petition as well. Then I filed for new H1B with a new employer. I went to get Visa in Hyderabad, they put me on Administration Process. After 2 and half a month, they denied my visa. My husband already lives in USA so now I am going to apply for H4. Do you think I will have any problems in getting H4 visa after rejecting for H1 twice? Please Advice. Link to comment
Attorney_7 Posted July 27, 2011 Report Share Posted July 27, 2011 Genearlly, previous visa denials need to be indicated on DS form, and also the consulate will have the record of the denials. However, previous denials are not necessarily a bar to a new application as long as one is eligible for the new visa category. Link to comment
