Received confirmation and receipt numbers from USCIS in Dec 2020. ---- My Parents are here in US on B2 Visa which expires in 2023. Their current I-94 expires in Feb 2021 ---- Question: Should I apply for their extension of stay for B2 ? OR Can they continue their stay beyond the I-94 expiry date (Feb 2021) based on the fact that their GC applications/petition have been received by USCIS? Quote Link to comment
pontevecchio Posted January 4, 2021 Report Share Posted January 4, 2021 Based on the pending I-140/AOS, they can stay till the decision. No extension needed. In fact any attempt to extend the B2 will be considered frivolous and denied. Quote Link to comment
