US Green Card for Indian Born Canadian Citizen

Recommended Posts

Hello,

I have been working and living in the US on H1B Visa and got i140 Approved. Now I wanted to move to Canada on PR and eventually Citizenship after 3 years.
My Current Employer(GC Petitioner) is not going to revoke my I140 petition. I wanted to pursue my US GC but I am sceptical how this will be affected. Can I still hold H1B status after surrendering Indian Passport?

You can still hold H1b status. As long as your employer continues to make a bona fide offer to employ you after you immigrate, your immigration case can continue even if you are not working for them and/or not in the US. Your wait will not get any shorter as that is based on your country of birth.
