ngngngngngngngngng Posted December 11, 2020 Report Share Posted December 11, 2020 (edited) Hello All, I was on my H1B (last year-6th year) and my H1B extension was pending based on I140 as per the employer and I lost my job, and could not travel back due to pandemic. I had to change my status to B2, and then also applied for extension of the same (B2). I want to know if I stay on B2 for a year can I still apply for H1B lottery next year. JoeF Posted December 11, 2020 Report Share Posted December 11, 2020 If you have an approved and valid I-140 for at least 6 months a new employer can file an H1 for you at any time. If you don't have an approved I-140 or the I-140 was revoked before 6 months were over you would have to be abroad for at least a year before a new H1 can be filed in the quota. Quote Link to comment
