How to obtain I-797 if Employer not giving.

My new H1b petition got approved this year but we have no onsite requirement anymore (Due to Covid). Hence my Employer not ready to send me for Visa interview and hence not ready to issue me Approval notice.

Now what can be my option for getting that approval notice? As I need that for switching my Job.

Many states require original H1b Approval notice (document) for renewing Driver's License.

Unfortunately I797 is employers document and there is no way for you to get it unless employer is willing to give it to you.

They probably revoked which is why they are not able to provide you the document but in general there should not be an issue as employers and employees have their copies/original 797. You need to work with them and find another project or work with another employer to file a new petition and get 797 from them.

You can only transfer the H1 if you at least get a visa. If the employer doesn't have a job for you you can not apply for a visa. It would be fraud.

If you found a new employer the new employer can file an H1 for you in April 2021 for a start date of Oct. 2021.

This is employer petition so its their chance. You cannot use it to get visa stamping on your own. You need new petition and new visa...
