Nixit Patel
Hello, I am currently on H1B and was thinking if I can create LLC for passive income such as stock market or rental income. I wanted to know if this is possible. Thanks Quote Link to comment
Leavemessageh1b
Not sure about stocks, rental income is possible if you stay out 100% and let property management company handle the business. Quote Link to comment
JoeF
A company by its very definition is about active income. You can't run the company, it would be unauthorised work. Quote Link to comment

rksingh
why do you need to create LLC for stock market investing for yourself?.....as long as you are investing your own money for yourself, you do not need a LLC. However be careful as excessive involvement in trading (such as day trading, for example) is usually not considered as passive and can create problems with terms of your H1B. Also investing for someone else is not considered passive. Rental Income can also create problems if you are involved closely with your rental property such as day-to-day management and routine maintenance. If however you simply own the property but pay to have a rental management agency take care of all duties that a landlord would take care of, then you may be OK. Consult a Immi lawyer for intricate details. Quote Link to comment
