Gan679
Hello Team, My H1-B is approved this fiscal year 2020 for 3 years but my Change of Status is denied , this means to say I need to exit and re-enter with the stamp to start my H1-B period. My OPT ends on FEB- 08-2021 . but now since my H1 was approved STEM turned inactive in SEVP. which left me with no F1 and H1 and a situation to depart immediately for stamping but later my School is getting the date fix since this was a counselor processing which gives back my OPT days which is until FEB-8th. Now, I should leave US after FEB- 8th for the stamping or should I be back before FEB-8th on the new stam ???. (I should not be working after that) ? What if my H1 is not stamped until FEB-8th ? ( IF i do not get the slots ) how many more days will that approval notice be active for me to get the stamping done ? Since now none of the consulates are open and slots are not available as it was previously, what will my stamping days look like , can I take such a long break and return ? Quote Link to comment
lovely
The better option is to exit via F1 status legally and enter via H1 status legally....since you have a little bit of time please check with your attorney on the best option for you. Quote Link to comment
