silkroute Posted November 11, 2020 Report Share Posted November 11, 2020 Is there a threat of losing H1B status if one takes elongated time off from work (3-4 months) on the the American Disability Act? This is after the H1B visa holder has already exhausted their FMLA benefits. HR has said that they will forward the application to the insurance company but can the work place fire a foreign national because they are on disability leave? Thank you. Quote Link to comment

Consult an attorney on this situation, because as per the new rules, now USCIS wants to know if you are on any Govt. assistance (while filing for h1b). Quote Link to comment
