Vivek Sharma Posted November 10, 2020 Report Share Posted November 10, 2020 Hello, I have been working on an H1B visa (First H1B ever) and have a I-140 petition approved (in the year 2017) with employer ‘A’. If I calculate (based in entry/exit days) the total term of my H1B utilized in the US is 5 years and 4 months and accordingly 8 months are remaining. Based on this below are couple of questions: 1.) If I change job to a new employer ‘B’ with only H1B transfers no Greencard application with employer ‘B’, can I get future H1B extensions on approved I-140 petition which was filed by my old employer ‘A’ since I did not initiate Greencard application with employer ‘B’? 2.) I am currently out of the US, Let’s say if I continue to be out of US for a period of 366 days, then will the H1B clock reset and the full 6 years term will be available again for me to stay on H1B in the US.
