H1 Denied in 2019 and now working in H4 EAD. Can my employer start the PERM process ?

Hi All,

My H1 extn was Denied in 2019 and now working with the same Employer in H4 EAD(valid till Feb 2023) attached with my spouse approved i140.

  • Can my current employer start the GC PERM process while I am on H4 EAD ?
    • If yes, please provide some reference to the process involved.
  • Is it mandatory to have H1B to initiate the PERM process ?
