Raviott Posted October 13, 2020 Report Posted October 13, 2020 My earlier employer is willing to file EB2 to EB3 downgrade and file AOS for my case as the dates are current. But in the event that the my I-140 for EB3 is denied. Will that impact my current I-140 and my Labor petition Quote
Jim2010 Posted October 15, 2020 Report Posted October 15, 2020 Born in India, all official documentation has a different dob than what is recorded in Birth Certificate (A 5 day difference). I am in US now, landed in 2009. The date of birth on all official documentation issued by INDIA/USA including SSN is taken from SSLC certificate. At present we are planning to submit AOS(I-485), and need to submit Birth Certificate. But we cannot use the current Birth Certificate or cannot get a non-availability. We are thinking of– to correct all official records to reflect Birth Certificate dob. We can get Passport corrected from Indian Embassy, however wanted to understand the implications of a DOB change to a non-us citizen’s record in US. Can SSA update their records? What will happen to the H1B VISA when we go for an extension which is soon due. Will there be problems when AOS is filed with an altogether new DOB? Quote
