dinezzh Posted October 8, 2020 Report Posted October 8, 2020 Hi All, I have a situation where in my daughter's i-94 is getting expired on 14-OCT-2020 though her H4 Visa is valid till 31-MAR-2021. Her i-94 validity was provided based on her passport during port of entry. I had renewed her passport now and filing extension for her through my employer. However, it is unlikely that it will get filed before her i-94 expiry date. As a primary H1B applicant, my i-94 and Visa is valid until 31-MAR-2021. Is it mandatory to file her extension prior to i94 expiry or can she continue to stay since as a primary applicant, I have validity until MAR 2021? What are the possible impact if it is not filed before the expiry date? What are my options to get her i94 validity extended other than exiting and re-entering USA? Please help!
