V1234 Posted September 29, 2020 Report Share Posted September 29, 2020 I-140 Petition was approved in 2009 in the EB3 (or employment-based “Third Preference”) category with a “priority date” of X. In 2012 employer filed a second I-140 Petition under EB1 and it was approved, with the same priority date of X. Subsequently the EB1 I140 approval was revoked due to some documentation error. In this case wanted to check is the first petition approval (Eb3 I-140) is still valid, or it would have become void ? Quote Link to comment
