User86 Posted September 8, 2020 Report Share Posted September 8, 2020 Hi, Am currently working with employer A on H1B, and got I-140 approved on 2018. Now I got a full time job with an Indian service based company B. I already burned out 4.5 years of H1B visa. If I transfer H1B to company B, company A will withdraw my approved I-140, and company B will start process filing I-140 only after an year and by the time I will be completing 5.5 Years on H1B, and the whole process for company B will take at least 6 months to file I-140 for company B. This is actually my whole situation is, so I have couple of questions, 1. In such case H1B maxout will apply for me as company A will withdraw my approved I-140? 2. Am I eligible for applying H1B visa extension (beyond 6 years) in future even after company A withdraws I-140 and company B is yet to file I-140? Kindly give me your suggestions on these queries.
