NeedHelpH1bExtension Posted September 2, 2020 Report Share Posted September 2, 2020 Hello Everyone, I'm really in a bad situation, h1b extension got denied today due to my criminal history. Background: In 2017, I was arrested for felony dui (felony because of involved in an accident, with bodily injury). I was convicted for 23153(a) and 23578 on April 2018 and sentenced for 5 days house arrest, 5 years of formal probation, court fines and 3-months dui course. I recently applied for h1b extension with same employer and same client at Texas service center and received an RFE (arrest records and speciality occupation). My attorney responded recently to RFE and today I received my denial(yet to receive details of denial, I will update the thread once I received it). I will talk to my attorney with my options tomorrow. Meanwhile, I want to reach out to this community to know if anyone had the similar experience and seeking suggestions on how I can come out of this situation. On side note, I applied for reduction and expungement of my case but it is not moving at all due to this pandemic and limited hearings of court. I have my current h1b valid until 09/14 and I-94 expired on 09/24. Questions: 1. Can I challenge my case if it's rejected due to criminal history because it's not related "Crime of Moral Turpitude"? 2. Should i re-apply through same employer or choose a different employer who can apply for H1b transfer? 3. Can USCIS reject my new petition based on my previous petition result? I know I shouldn't have drink and drove in the first place, I'm truly sorry for what I did. I have learned a huge life lesson from it. Really appreciated for reading my post.
