Privx Posted August 25, 2020 Report Posted August 25, 2020 Hi, my H1B extension denied recently, and i94 expired in may. Due to covid symptoms, I couldnt travel to my country. I am planning to file h1b transfer through another employer. Will it work at this time? Is it legally possible? Kindly suggest Quote
gopalakrishnach Posted August 26, 2020 Report Posted August 26, 2020 i94 expired in may --- it means you were staying in USA since you had H1B petition with USCIS under processing? I feel now you do not have I94 and no petition with USCIS I feel you need to leave ASAP. Please consult experts. Lets see what others say Quote

Kindly suggest Apply for an MTR (I think you have 30 day time period) and if it is accepted and your case re-opened, you may be able to transfer to another employer, BUT do not forget to withdraw this previous H1b. Denials do not look good on your immigration records. How about your I-94 is it current? Lets see what other experts say. Edited September 4, 2020 by Zodiac System Quote
