martinv Posted July 20, 2020 Report Posted July 20, 2020 I was working for Employer A and moved to Employer B after my H1B transfer approval. My spouse is working in H4 EAD and she got her new H4 and EAD based on my new I-797A. We did not get stamping until now (we did not go out of US) and we got extension as part of this H1B transfer (I have my I-140 with Employer A). Currently I am working for Employer B and Employer A asking me to come back if possible. Do we need to file new H1B transfer to work with Employer A? If I move to Employer A, do we need to apply for new EAD based on the H1B sponsored by Employer A? Also, if I go back to Employer A, do I need to file for new I-140 again? Quote
User099 Posted July 23, 2020 Report Posted July 23, 2020 New H1 might be needed if the old H1 with emp A was revoked. New H4 and EAD will not be needed, unless you want to keep H1 and H4 expiry dates in sync. Quote
Zodiac System Posted July 24, 2020 Report Posted July 24, 2020 Employer A is asking you to come back, which is positive and a good sign and therefore gives the impression that he may not have revoked your H1b or I-140 with him. You can check on this with him. Quote
