andy.anand14 Posted July 3, 2020 Report Posted July 3, 2020 Regarding H1B Extension - considering worst case scenario ( friend case) Details: He have valid visa/petition till Mid-Nov 2020 & I94 till Mid-Nov 2020. He will have documents ready by 1st week of Aug 2020 with SOW of Mar 2021 for extension filing. He will be on FMLA leave in Aug Mid to Sep Mid. Question : 1. Should he do premium in Aug 20 or Sep 20 so that, in case of reject so he can file another petition or change of status to B1/B2 to have more time in US. 2. Should he file late petition with normal processing in OCT 20 before I94 expire so he will have more time? 3. In case of need, Can he can file B1/B2 after I94 expiry (if h1b extension rejected after I94 expiry)? 4. In case of premium petition rejection, will his I94 will be valid ? Or they change I94 date with that? Basically, he would take out more time in US so that he do not have to travel early with his new born baby and worst case if he can change the status to B1/B2 is also fine. Quote
