mumbai124 Posted June 23, 2020 Report Posted June 23, 2020 Hello, Good Evening. Can someone please answer the following question? Can someone whose H1B extension application is pending with USCIS (with previous H1B period past its last date) move to H4 visa in the light of new executive order signed by the President of the US? - This person is currently in the US. - This person wants to avoid international air travel. Thanks! Quote
Yash_Rangi Posted June 23, 2020 Report Posted June 23, 2020 See full text of Exec order below. It will not apply if you are already in the USA. Be there and avoid international travel for next 6 months. https://www.whitehouse.gov/presidential-actions/proclamation-suspending-entry-aliens-present-risk-u-s-labor-market-following-coronavirus-outbreak/ Quote
gopalakrishnach Posted June 23, 2020 Report Posted June 23, 2020 If the person is already in USA and have current H1B petition in processing they can also have new H4 petition processing with USCIS. In case H4 the primary applicant must be on H1B. Quote
User099 Posted June 23, 2020 Report Posted June 23, 2020 Most likely No if you I94 is already expired, but you should check with an attorney. This has nothing to do with the EO. Quote
