SureshTeja Posted June 17, 2020 Report Posted June 17, 2020 Dear Sir/Madam Good day I am Suresh and I have concern on H1-H4 Visas. If this question is already answered please share me the link. My question is, I have applied for H1 visa to my spouse. This H1 status is on RFE and pending to be approved. Can I apply for H4EAD in mean time since we are not sure how long it can take my spouse H1 to be approved or it can be rejected also? What are my options at this conjunction because of uncertainties. User099 Posted June 18, 2020 Report Posted June 18, 2020 Is she on H4 currently? If she is on H4 and she is eligible for EAD, you can apply for it. Filing for an EAD will not have any impact on her H1. Is this a Cap subject H1 for her (First time H1)? Quote
