Jura Posted June 16, 2020 Report Posted June 16, 2020 We got our Green Card this month.We now want to sponsor our daughter in the F2B category, since she aged out during the long wait as our Priority Date became current. She is now working on an OPT EAD and has applied for the STEM extension. Is it safe for us to apply for her Green Card when her STEM OPT is under process? Or should we wait till she gets the card? Jura Posted June 17, 2020 Author Report Posted June 17, 2020 Thanks. We intend to consult a lawyer. CSPA may not help because after our I140 approval, she got only 6 months extra time. She is now 25. Also unfortunately, even though her name was on the I140 as a dependent, the F2B will use a new Priority Date since I130 is a new application. Quote
