nk12 Posted June 15, 2020 Report Posted June 15, 2020 I am a US citizen and I went into an arranged marriage with my wife in February 2017. Her greencard filing got approved in June 2019 and she moved to the US in July 2019. Within months of her moving I realized that this marriage was a mistake and earlier this month she left me and is now living at her friend's place. Not only was I under the pressure due to loss of work due to covid 19, she also made it hard for me to live at home in peace. There's never been any violence to which she admits but she also doesn't want to live with me. As soon as her greencard came in the mail, I handed it over to her. I want to understand what my rights are. I am unsure if hers is a conditional greencard or not. If not how can I approach the legal system? Does she get deported if we file for divorce? Please help Quote
newacct Posted June 15, 2020 Report Posted June 15, 2020 (edited) You have the right to divorce unilaterally. You do not have the right to get her deported. Whether she can stay is between her and the government, and if she is a conditional permanent resident, she can apply for Removal of Conditions by herself after divorce, assuming the marriage is bona fide.
