myvisaextn Posted June 14, 2020 Report Posted June 14, 2020 Hi My H1/I94 validity expired on 1/31/2020 and got an RFE 1st week of May'20 for the extension. RFE due by Mid Aug2020. In this scenario, am I allowed a grace period of 60 days due to COVID to reply for an RFE? and what is the max period 240 days affect for RFE? Is there any exemptions due to the current COVID situation for 240 days grace period. Completed 5 years of H1B. Appreciate your advise in this. Quote
gopalakrishnach Posted June 15, 2020 Report Posted June 15, 2020 I feel they allowed 60 days grace period of RFE due to virus. I may be wrong. 240 days has no grace due to virus. I may be wrong. Quote
myvisaextn Posted June 16, 2020 Author Report Posted June 16, 2020 Thank you Gopal for your response. Can we reply the RFE with new Client B details since I came out of the project with Client A during the time of extension filing. Quote
User099 Posted June 16, 2020 Report Posted June 16, 2020 You have 60 additional days to reply to the RFE, but the 240 days has not been extended. Quote
gopalakrishnach Posted June 16, 2020 Report Posted June 16, 2020 For Client A RFE you cannot reply with Client B. Your petitioner must take care of this. Quote
myvisaextn Posted July 13, 2020 Author Report Posted July 13, 2020 What's the criteria for 240 days count? from the date of expiry of I-94 or the date of receipt of H1B Extension or whichever is earlier? Please clarify Quote
