Sreekanth Abburi Posted June 12, 2020 Report Posted June 12, 2020 Hope you are doing great. Need your help in answering the below question if you are aware: Am currently in US on H4. I got Selected H1B lottery in 2015 and came to US in Jan 2016 and worked here till Jun'18.During that tenure my H1B was valid till May'20. My project was done in Jun'18 and Later in Oct'18, I went to india for H4 visa and got stamped and came back to US in Jan'19 on H4 visa. So, Just want to check if I get any job offer here in US, can my employer initiate H1B transfer here or Do I need to go for visa stamping to any country. Regards, Sreekanth Quote
gopalakrishnach Posted June 15, 2020 Report Posted June 15, 2020 Any employer can start H1B petition while you are in USA on H4. Once you get receipt you can start working. If consular need to get stamped else no need. I am not sure when it will be consular. Quote
User099 Posted June 16, 2020 Report Posted June 16, 2020 You can file for a COS to H1 and once approved you can start working. If your COS is approved, you don't need to go for visa stamping. Quote
