Shweta94 Posted June 10, 2020 Report Posted June 10, 2020 Hello, Any help with my situation below is highly appreciated. I am currently working on L2 EAD expiring Jun 2021 and have an approved i140. My spouse will be moving to H1B from L1 and as per information available online, H4 EAD can only be filed after returning back to US with H1 and H4 visa activated. So, is there a way I can avoid a gap in my L2 TO H4 EAD transfer? Thanks! Quote
User099 Posted June 11, 2020 Report Posted June 11, 2020 Your husband will need an I140 for you to get H4 EAD. Just moving to H1 will not get you a H4 EAD. Quote

User099 Posted June 12, 2020 Report Posted June 12, 2020 For filing H4 EAD you will need to be in US. If you are filing a H4 and EAD together they will mostly get approved at same time so you will not have any gap. Quote
