She got an RFE and refiling would happen next month.Just in case if her extension gets denied, what are our options in converting her to a H4 without leaving the country? I have a valid H1.Really don't want here to travel with the child during this covid -9 scenario.Thanks Quote Link to comment
02112018 Posted May 27, 2020 Report Share Posted May 27, 2020 Contact attorney to see if H1-B gets denied, is there a timeline to file H1 to H4. If not simultaneously you got to file h1 to h4 if you have doubt that it might get reject. Quote Link to comment
User099 Posted May 29, 2020 Report Share Posted May 29, 2020 You should have filed an H4 before her I94 expired. Check with an attorney to see if they can file a NPT and file a H4 or B2 in case the H1 is denied. Quote Link to comment
