H1-B visa stamp with I-140 on appeal

I want to get an H1-B visa stamp in the philippines while my I-140 was denied and on appeal coz DOL can't produce a duplicate copy of my labor cert that was approved in 2001. I also have another I-140 application that is still pending. Do you think I will be able to get a visa stamp? The H1-B that I have right now if from the original I-140.
