The subsidiary I am working with currently is looking for investments and funds and planning to move to for- profit C corporation, how will this affect my cap- exempt H1b and what are my options? gopalakrishnach Posted March 12, 2020 Report Share Posted March 12, 2020 I am not sure but it seems you are moving from non-profit to profit so your H1B criteria changed. Since your are moving from non-profit to profit I guess you need new H1B under cap. I may be wrong. Quote Link to comment
User099 Posted March 13, 2020 Report Share Posted March 13, 2020 If you always had a cap exempt H1 and never went though the lottery, they you can't transfer from non profit to a for profit organization. You will need to go though the lottery process. Quote Link to comment
JoeF Posted March 13, 2020 Report Share Posted March 13, 2020 If you have not been counted for the quota your employer would have to file an H1 in the quota, for a start date of Oct. 1. Your only other option would be to get a job at another non-profit research institution. Quote Link to comment
