In the email notification received from USCIS. It is mentioned Please note: Consulate notified (if applicable): CHENNAI I am not sure what it is, I asked my employer he says we need to wait for approval hard copy to know if my approval with change of status within US or not. My old I-94 is expired Sep 2010. Do I need to leave US and get visa stamped at Chennai? If I get I-94 attached with approval hard copy, do I need to still exit the country to get stamped? Attorney_13 Posted October 15, 2010 Report Share Posted October 15, 2010 One will need to wait to receive the actual approval notice from CIS to confirm if an I-94 card was issued and the change of status was approved. If no I-94 card is attached, then the change of status was not approved and one would have to depart the US and obtain an H1B visa from a US Consulate abroad. In addition, you may be accruing unlawful presence since the expiration of your last I-94 card if this approval was not issued with an I-94 card. In this case it is crucial to depart the US as soon as possible to avoid triggering any bars. I am waiting for the original approval letter but wanted to check with you to see if you got the I-94 card with the approval letter. Could you please let me know? I had filed for H1B extension/transfer in June 2010. My I94 expired in August 2010. I just got the H1B approval yday with consular processing. Did you get your visa stamped in India? Can you please let me know if we can go to Mexico or Canada for stamping or do we have to go to INDIA for it. Univemp Posted August 31, 2011 Report Share Posted August 31, 2011 All the Consulate notification e-mails mean only one thing: Its I-797B without I-94. i got mine today and will leave ASAP for visa stamping in India. I think the rest of you guys in a similar situation should do it like me. Don't go to other countries...it can be very risky and mess up any chances you may have. Link to comment

I left immediately bcoz i was out of status.I think you should do the same and get stamped only at the place they mentioned on the copy. Hope this helps. Gud luck ..... Link to comment

Univemp Posted September 29, 2011 Report Share Posted September 29, 2011 Hi godblessme, I did not have an expired I-94, however my H1B (extension) which was valid till January 2013 was revoked by my previous employer a couple of days before my present H1B application from my present employer was received by USCIS. This caused a loss in status. Fortunately my EB1A got approved and now I am adjusting status. Link to comment

Univemp Posted January 10, 2012 Report Share Posted January 10, 2012 Hi All, When the USCIS notification says Consulate Notified, its positive that the Change of status has not been approved and you need to leave the country immediately and get visa stamping from abroad...I had similar notification, but then my EB1A got approved. So, i stayed back without job, filed AOS and now my GC got approved in 101 days. i also got EAD/AP in 63 days...but cases like mine are rare... Link to comment

Now I have new H1B Extension (I-797B) approval notice which is valid from Jan 4th 2012 - Sep 18th 2014 without I-94 attached to it. I would like to know whether I can go to canada for visa stamping?? alluri_a_varma Posted January 19, 2013 Report Share Posted January 19, 2013 Guys, i am reopening the post to get views from everyone who has this experience. here's the situation my wife got a similar approval mail for COS from F2 to H1 her present I94 has D/S when entered US on F2 - i.e till the Duration of Status and I20 copy of her's was valid till 2015. Beneficiary: XXXX DOB: XX/XX/XXXX Classification: H1B Starting Validity Date: 02/01/13 Ending Validity Date: 09/30/15 Consulate notified (if applicable): CHENNAI I-94 # (if applicable): XXXXXXX So in this case , as she was having a valid I94 - Does she still need to go for restamping ?
