h1b_alien
I have port-of-entry question. I am currently working in USA with H-1B visa. I was in a Company-A before and it got acquired by Company-B and now currently working in Company-B. I have my Company-A Visa Stamped in my Passport and the visa stamp has validity till 14-May-2020. Also, I have amended my H-1B petition from Company-A to Company-B and the amended petition is valid till 31-Oct-2020. I have an upcoming travel plan on Mar-2020. I will be leaving USA on 6-Mar-2020 and might be coming back to USA on 20-Mar-2020 (which is within my Passport Visa stamped validity date and also it's with my previous company - 'Company-A'). Question: So, can I travel and enter back to USA using my previous company (Company-A) Visa stamped in my passport (which is valid till 14-May-2020) and submit the Company-B H-1B petition at the port-of-entry? (or) do I need to get the new Visa stamped with my current company (Company-B) for re-entering the USA at the port-of-entry? Pls advice. Thanks. Quote Link to comment
User099
You can do this, enter back to USA using my previous company (Company-A) Visa stamped in my passport (which is valid till 14-May-2020) and submit the Company-B H-1B petition at the port-of-entry Quote Link to comment
gopalakrishnach
Yes you can come back with old stamped visa with new H1B approval notice... Quote Link to comment
cyberlord
Yes, as long as your H visa is valid (irrespective of employer) you can enter. Quote Link to comment
