rksusa Posted February 7, 2020 Report Share Posted February 7, 2020 Hi, Here is my situation. Working for Employer A at Client location. 797 expired on Sep 5, 2019. Had filed extension + amendment in July and got RFE on Jan 09,2020. yet to respond to RFE. Have approved I140 with Employer A 797 - Expired Sep 5, 2019 I94 - Valid december 16, 2021 I am looking for FT with the same client. Can I do H1B transfer as I still have my I94 valid? Is it recommended to try with the FTE position in this scenario with the latest H1B approval rate? Or should I just wait for the original 'extension + amendment' to get approved? User099 Posted February 10, 2020 Report Share Posted February 10, 2020 You should be able to do a transfer as your I94 is valid. Transferring to an FTE is better, but it again depends on the individual case and you can't generalize it. Quote Link to comment
