SSKALE
*asking for a friend* He is in 6th year H1b - his 6 years will complete in oct 2020. However Next is H1B extention which can be done only if we have I140-which he has already. We want to make sure and know will this affect H4 visa stamping for his wife which we are planning in April. please let us know in case there could be any potential risks with denials. cyberlord
If I am not wrong, you can file for H1 extension 6 months prior to expiry, that is in April. Try to get the extension done in premium processing and carry approval notice for H4 interview. Please check if there are any other alternatives. Quote Link to comment
gopalakrishnach
Since your friend has already approved active I140 he can apply for H1B extension beyond 6 years. He can apply for H1B extension before 6 months of H1B end date. Ask your friend to apply for H1B extension, get it approved and after that H4 can go to visa interview with H1B extension approval copy... Quote Link to comment
User099
There won't be any issues. Either apply for extension and go for the interview with the new approval notice or wait for her to come to US and then apply for H1 and H4 extensions. Quote Link to comment
