Amit Dhingra
Hi, I applied for H1B Visa couple of years back for the first time (2016). The case was not Approved / Processed. Employer does not exists now, The case has been withdraw. My case is changed to status "Withdrawal Acknowledgement Notice Was Sent" couple of months back only i.e. Oct'19 Will this fall under H1B cap exempt ? Can this case be taken forward (Transfer) by any other employer or Fresh File is required in cap. Thanks Quote Link to comment

cyberlord
If you had traveled to US for the same employer on H1-B, you would have now been cap-exempt. Unfortunately, that is not the case. Quote Link to comment

Unfortunately, that is not the case. Well, the case was never approved, so the OP could not travel with the H1 at all. Not approved = not counted for the quota. Quote Link to comment
