gopalakrishnach Posted January 23, 2020 Report Share Posted January 23, 2020 Yes... but your employer who got I140 approved must not revoke it for 180 days. After 180 days they cannot revoke it. Using I140 anyone can apply for new H1B. As per law once you quit your employer must let USCIS know that you do not work for them and revoke H1B else they must pay you. Quote Link to comment

Hopefully your employer will hold your current I140 or else you will have to do PERM and I140 again, but you will maintain the PD. Quote Link to comment

Thank you @User099. I will be leaving them on good terms - I need to be in India with my parents for few months (medical situation). After I quit Employer A, will I be able to join another Employer B after spending few months in India? I have obtained 3-year H1-B extension using Employer A's approved I-140. Thanks again. In both cases, your employer A/B will have to file for a new H1. If you join a new employer they will have to start the GC process again. Quote Link to comment
