Manish Ravlani Posted January 23, 2020 Report Share Posted January 23, 2020 Hi. I was on H1B from Oct 2014 till Oct 2018 with I140 approved. In Oct 2018, I had to switch to H4 due to some reason. I am planning to switch back to H1 sometime this year. I was wondering if for my future COS from H4 to H1, will I be still cap exempt as I got my initial H1 based on lottery? And if yes - is there any max time that I need to file my H1 to stay cap exempt? Thanks for comments. Quote Link to comment
