SK558
Hello, This family visa case got placed in admin processing after the consular interview, and has not shown any progress. It has been 3 months since the requested documents were submitted. Specifically, one of the document requests was for photographs to establish relationship between the petitioner and beneficiary. These are not available and we submitted a clearly labeled/worded request to move straight to DNA testing as part of the response to AP request, but the consulate is not responding or acknowledging any of our submissions and follow up emails. Any advice on how to proceed? Thank you! Quote Link to comment
Attorney_15
There are unfortunately not many good options when a case is stuck in Administrative Processing. One thing a party can try is when DNA testing can help, such as in a mother-child, relationship, one might want to consider getting DNA testing and submitting the results to the Consulate as an example of what can be shown. While it might not be sufficient by law because it is not done at the Consulate's instruction, it might help prompt the Consulate to act. One may wish to consult with an immigration lawyer for case-specific advice considering all facts. Quote Link to comment
