abhinav26 Posted January 9, 2020 Report Share Posted January 9, 2020 Hi all, My H1b visa is expiring in June, 2020 but my 6 year duration will end in December 2020 (including days not spent in US). My question is that does my company need to apply for an extension for this gap or will I be able to work in my current position without a need for an extension (till the end of my 6 year period)? My company is in process of applying green card for me but I know almost definitely that my application will not reach I-140 status by June (when my H1b expires). Mav777 Posted January 10, 2020 Report Share Posted January 10, 2020 Didn’t you apply for an extension after 3 years were up?The 6 year period is allowable by law, it’s not an automatic. You are only in valid status till your I797 / I 94 date. Ofcourse you will have to apply for an extension. Quote Link to comment
