Chidambaram85
I was sent to US from my previous organization in H1B. I stayed there between 2011 and 2014. While in US I applied for extension and my Visa was valid until April of 2016. Then I quit the organization and moved to another firm by 2015. My question is if I apply for H1B now will I be eligible for out of cap or will my application still go into lottery? I heard from someone that up until 5 years from the date of expiry of my Visa my application will not go into lottery. Please clarify. Thanks in advance for your help! Quote Link to comment
User099
You will be cap exempt even if your new origination decides to file for a H1 for you. Quote Link to comment
gopalakrishnach
So were you on H1B from 2011 till 2016 ? Without I140 approved you can get max of 6 years of H1B. With I140 approved you can get more than 6 years... Quote Link to comment
