H1B approved/Visa stamping is in administrative processing/can I reactivate my sevis and travel back to US on F1 visa?

Recommended Posts

Hello

My H1B(i797A) is approved till Feb 7th, 2020. I work in EVC modal in USA. I went for H1B visa stamping on Nov 19th 2019 at Hyderabad, India and was issued with 221g white slip without requesting any additional documents and my passport is returned back to me. Since then there is no update. It has been 40 days till date(12/27/2019).

My STEM OPT is valid till October 2020. So I was wondering if I can travel back to US on my F1 visa.
Since 10/01/2019 my sevis is inactive i.e., after my H1B approval. Is there a way to reactivate my sevis and travel back to US on my F1 visa?
Does my employer need to revoke or withdraw my H1B inorder to reactivate my sevis?

Thank you

Check with a immigration attorney to be 100% sure. They might suggest you options.

@Joy eunice SEVIS record can be reactivated by submitting a datafix to SEVP. This task can only be performed by the DSO. However the official H1b revocation letter is required for the  datafix and your employer will have to withdraw your petition. USCIS takes approx 3 months to issue revocation notice/letter.
